4. Orders and Payments

If you purchase any products or services from us, you agree to provide current, complete, and accurate payment and billing information.

We reserve the right to cancel or refuse any order if:

• customer owes Patent Apostille money
• payment is not authorized
• inaccurate information is provided
• fraud or unauthorized activity is suspected
• the product or service becomes unavailable

It should be noted that governmental service fees may rise during the course of our procuring apostilles. In such cases, the customer will be responsible for satisfying those higher fees. Patent Apostille reserves the right to delay delivery of apostilled documents until all account balances have been satisfied.

All prices are listed in U.S. Dollars unless otherwise stated.

5. No guarantees that apostilles will be secured

Obtaining apostilles on patent and trademark filings is a function of the discretion of the United States Patent and Trademark Office (USPTO) as well as the United States Secretary of State (USSES). Patent Apostille will use reasonable business efforts to produce certified documents from the USPTO and apostilles from the USSES. However, these offices may not grant certified copies or apostilles. Further, the granting of certified documents from the USPTO and apostilles from the USSES takes many months. Government workforce reductions are likely to cause further delays.

6.  Refunds

No refunds for any of our services will be provided, except for gross negligence on the part of Patent Apostille. Any such refunds for gross negligence will be limited to our service fees and will not include fees submitted to the USPTO or the USSES.

7. Disclaimer

This website and all content, products, and services provided through it are offered on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, Patent Apostille disclaims all warranties, including but not limited to:

• merchantability
• fitness for a particular purpose
• non-infringement
• accuracy, reliability, or availability of the website

8. Limitation of Liability

To the fullest extent permitted by law, Patent Apostille, its directors, employees, affiliates, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the website, products, or services.

This includes, without limitation, loss of profits, data, business, opportunities, or goodwill.

9. Hold Harmless

You agree to hold harmless Patent Apostille and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:

• lack of success in securing apostilles, providing no acts of gross negligence were committed by Patent Apostille
• your use of the website
• your violation of these Terms and Conditions

10. Termination

We reserve the right to suspend or terminate your access to the website or services at any time, without notice, if we believe you have violated these Terms and Conditions or applicable law.

11. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Arizona.

12. Changes to These Terms

We may update or modify these Terms and Conditions at any time without prior notice. Changes will be effective upon posting on this page.

Your continued use of the website after any updates constitutes acceptance of the revised terms.
